Terms of Service
Effective date: [EFFECTIVE DATE — set before launch]
These Terms of Service ("Terms") are a binding agreement between you and Walking Visuals LLC, a North Carolina limited liability company that operates nexTTable ("nexTTable," "we," "us," or "our"), and govern your use of the nexTTable mobile app, the nexttableapp.com website, and our marketplace for buying and selling physical trading cards (together, the "Service"). By creating an account, browsing, buying, selling, or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.
Please also read our Privacy Policy, which is part of these Terms, and our Seller Policy, which applies if you sell on nexTTable.
1. Who can use nexTTable
- You must be at least 17 years old (or the age of majority where you live, if higher) to use the Service.
- You sign in with Sign in with Apple. You're responsible for keeping access to your Apple ID secure and for activity under your account.
- Provide accurate information, and keep it current. Don't impersonate anyone or create an account for someone who is barred from using the Service.
- You may not use the Service if we've previously suspended or removed you, or if the law where you live prohibits it.
2. What nexTTable is (and isn't)
nexTTable is a venue that connects independent buyers and sellers of physical trading cards. Sellers ("vendors") list and sell their own items; buyers purchase them. Except where we explicitly say otherwise, nexTTable is not the buyer or seller in any transaction, does not own the items listed, and does not take possession of them. The contract of sale for an item is between the buyer and the vendor. We provide the platform, payment facilitation, and tools to help transactions go smoothly, but we don't guarantee the quality, safety, legality, authenticity, or grading of any item, or that a buyer or seller will complete a transaction.
3. Zero tolerance for objectionable content and abusive behavior
nexTTable has zero tolerance for objectionable content and abusive users. This is a firm rule, not a guideline. When you post content or communicate through the Service — including listings, photos, reviews, offers, want lists, communal table chat, and dispute messages — you must not submit, and must not engage in, any of the following:
- Harassment, bullying, threats, stalking, hate speech, or content that demeans or attacks people based on race, ethnicity, national origin, religion, sex, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic.
- Sexually explicit or pornographic material, or content that sexualizes minors in any way.
- Violent, graphic, or otherwise obscene content, or content that promotes self-harm or illegal activity.
- Spam, scams, phishing, fraud, or attempts to deceive or defraud other users.
- Impersonation, doxxing, or sharing another person's private information without consent.
- Any content that is unlawful, infringes others' rights, or violates these Terms.
Reporting and blocking. Every place users can post or message includes a way to report content and to block or mute an abusive user. In communal chat, vendors who host a room can also remove messages and remove, time-out, or ban a user from that room.
Our response. We review reported content and act on objectionable content and abusive users — typically by removing the content and, where warranted, suspending or permanently removing the offending user's account. We aim to act on reports of objectionable content within 24 hours. We may remove content or suspend accounts at our discretion to keep the community safe, and we cooperate with law enforcement where appropriate.
4. Prohibited and restricted items
You may not list, sell, or attempt to buy:
- Counterfeit, fake, replica, "custom," reprint, or proxy cards represented as genuine, or any item that infringes a trademark or copyright. Counterfeits are strictly prohibited.
- Stolen goods, or items you don't own or have the right to sell.
- Items with tampered, forged, or misrepresented grading, certification, or authentication.
- Anything illegal to sell, or whose sale is restricted, where you or the buyer are located.
- Items outside the categories nexTTable supports (physical trading cards and directly related collectibles), unless we've expressly allowed them.
- Weapons, drugs, hazardous materials, adult content, live animals, or other items unrelated to trading cards.
Vendors are responsible for the accuracy and legality of every listing. See the Seller Policy for full listing rules.
5. Buying on nexTTable
- When you buy an item, you agree to pay the listed price plus any shipping and applicable taxes shown at checkout. You're entering a contract to buy that item from the vendor.
- Payment is processed by Stripe (see section 7). Placing an order authorizes the charge for that order.
- Descriptions, photos, condition notes, and any grading are provided by vendors. Review them carefully; if a listing seems inaccurate or counterfeit, report it.
- Offers you submit through the Service are genuine commitments to buy at the offered price if the vendor accepts, subject to availability.
- Shipping timelines and methods are set by the vendor. Risk of loss and title pass to you when the item is delivered, unless the law provides otherwise.
6. Selling on nexTTable
Selling is governed by these Terms and the Seller Policy. In summary, vendors must:
- List only items they own and are legally allowed to sell, described honestly and accurately, with real photos.
- Honor accepted orders and offers, ship promptly, and communicate professionally.
- Complete Stripe onboarding (including identity verification) to receive payouts, and keep payout details current.
- Comply with all applicable laws, including tax and consumer-protection laws, and handle their own tax obligations.
7. Fees and payments
- Buyers pay no platform fee — just the item price, shipping, and any applicable tax.
- Vendors pay no monthly fee. On completed sales, vendors pay a 10% fee (7% platform + 3% card processing). The transaction fee is 10% of the item subtotal only — shipping is excluded from the fee. There are no per-listing fees.
- Payments, payouts, and identity verification are handled by Stripe under Stripe's terms and privacy policy. By transacting, you also agree to the applicable Stripe terms.
- Fees may change; we'll give notice of material changes and update these Terms. Continuing to sell after a change means you accept the new fees.
8. Disputes, returns, and refunds
- If an order arrives not as described, damaged, counterfeit, or not at all, open a dispute in the app. Buyers and vendors are expected to work in good faith to resolve it.
- nexTTable may, at its discretion, help mediate disputes and — where a charge was made but the order can't be fulfilled as charged — facilitate a refund through Stripe. We are not obligated to resolve every dispute in any particular way.
- Refunds, when issued, are returned to the original payment method via Stripe. A vendor's individual return policy may offer more than this baseline, but not less than the law requires.
- Chargebacks and payment reversals are handled under Stripe's processes; abusing them may result in account action.
9. Content you post; license to us
You keep ownership of the content you post (listings, photos, text, reviews, messages). You grant nexTTable a non-exclusive, worldwide, royalty-free license to host, store, display, and use that content to operate, promote, and improve the Service. You're responsible for your content and confirm you have the rights to post it. We may remove any content that violates these Terms, and we may retain records as needed for legal, tax, and dispute-resolution purposes.
10. Intellectual property
The Service — its design, software, text, logos, and the nexTTable name and folded-T logo — is owned by Walking Visuals LLC or its licensors and protected by law. "nexTTable" and the nexTTable logo are trademarks of Walking Visuals LLC. You keep ownership of the content you post (your listings, photos, messages, and reviews); posting it grants us only the limited license described in section 9 so we can operate the Service. We grant you a limited, personal, non-transferable, non-exclusive license to use the Service for its intended purpose. Trademarks, card artwork, and characters shown in listings belong to their respective owners; Walking Visuals LLC and nexTTable are not affiliated with, sponsored by, or endorsed by any card manufacturer or grading company.
11. Third-party services
The Service relies on third parties, including Apple (Sign in with Apple, app distribution), Stripe (payments and payouts), and Anthropic (the AI provider behind optional AI features). Their own terms and privacy policies apply when you use those parts of the Service. We're not responsible for third-party services we don't control.
12. Suspension and termination
You may stop using the Service and delete your account at any time (Account → settings → Delete account). We may suspend or terminate your access — with or without notice — if you violate these Terms, create risk or legal exposure, or engage in objectionable or abusive behavior (section 3). On termination, your right to use the Service ends; sections that by their nature should survive (fees owed, content license, disclaimers, limitation of liability, indemnification) survive.
13. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't warrant that items listed are authentic, accurately described, or of any particular quality, or that the Service will be uninterrupted, secure, or error-free. You transact with other users at your own risk.
14. Limitation of liability
To the fullest extent permitted by law, nexTTable will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service or any transaction with another user. Our total liability for any claim relating to the Service is limited to the greater of the fees you paid us in the 12 months before the claim or US $100. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold nexTTable harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your content, your transactions, your violation of these Terms, or your violation of any law or third-party right.
16. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina and the United States, without regard to conflict-of-laws rules. Walking Visuals LLC is organized in North Carolina. Any dispute between you and Walking Visuals LLC will be resolved in the state or federal courts located in North Carolina, and you consent to personal jurisdiction there, unless applicable law requires otherwise.
17. Changes to these Terms
We may update these Terms as the Service evolves. When we make a material change, we'll revise the effective date above and take reasonable steps to notify you. Continuing to use the Service after a change means you accept the updated Terms.
